The National Executive have considered the impact of the Labour Court decision as presented to AGSI on 3 November.
The National Executive also considered a proposal submitted by the ‘Official Side’ to the Labour Court dated 31 October 2016, and which forms part of the overall Labour Court recommendations.
In considering the proposals the Executive requested that the financial impact be assessed and so engaged the assistance of an actuary to outline those impacts.
I am attaching for your information a document outlining the estimated financial implications for members working the Core, Non-Core and those employed 9am-5pm Monday to Friday.

THE FIGURES PROVIDED ARE ESTIMATES AND FOR ILLUSTRATION PURPOSES ONLY. THEY SHOULD NOT BE TAKEN AS AN ACCURATE REFLECTION OF ANY INDIVIDUALS SPECIFIC EARNINGS.
In drafting these figures the actuary made the following assumptions:
- Unsocial Hour payments are calculated at the maximum potential earnings at each point referenced on the pay scale and in the case of:
(1) Core; are calculated at a maximum increase of 25% of basic pay.
(2) Non-Core; are calculated at a maximum of 20% of basic pay and based on 3 earlies/3 lates for calculation purposes only.
Also shown in these figures are:
(1) A €750 pension levy reduction which took effect on 1 January 2016; and
(2) A €1,000 pay restoration payment due in September 2017.
These figures are included because during our negotiations the Department of Justice and the Department of Public Expenditure & Reform insisted they had to be taken into account in the overall process.
The full details of the Labour Court recommendation together with the proposals from the ‘Official Side’ dated 31 October 2016 will be circulated to all members as part of the ballot pack.
Included in these proposals are matters relating to:
(1) The Public Service Pay Commission;
(2) Service recognition – the opportunity to buy back 6 months of service for members who joined between 1989 and 2013;
(3) Review of provisions in relation to complaints to GSOC; and
(4) The Modernisation and Renewal Programme 2016-2021;
Full details of these elements will be provided to members as we move towards balloting.
The AGSI National Executive have considered the Labour Court recommendations and the proposals from the ‘Official Side’ dated 31 October 2016 and have decided to recommend acceptance to our members.
